How is your residential building permit reviewed?


Once you have submitted your residential permit application, it will undergo a review process. The relevant authorities will need to go through your entire application with a fine-tooth comb in order to ensure that everything is in accordance with the local laws and building codes. This process can take some time but it is certainly better than the alternative. Building without a permit can have devastating consequences.

First things first, the staff at your local municipality will review the application and confirm that the proposed work is in compliance with the Building Code as well as any other applicable laws detailed in the Building Code. These include the zoning bylaws. Your application might also be sent to other local or municipal officials for comments. 


If your renovation project or basic alterations are simple, the application will be passed quickly. Provided everything is in order, of course. More complex proposals can take longer since they will require a complete permit application review by the municipality. In general, the timeframe for a building application for a house is approximately 10 days. If the structure is more complex, it can take up to 30 days. The municipality is required to approve or refuse the application within this period of time. 

In the case of a refusal

If your application is refused, you will be provided with a reason why the application was not successful. If you are not able to resolve the problem with the municipality, you have a few options. If the problem is related to the technical requirements included in the Building Code, you can submit an appeal to the Building Code Commission. If the problem is related to the compliance with other laws like the interpretation of the zoning bylaw, you can appeal to a judge of the Superior Court of Justice. The judge will review the matter and provide a ruling as promptly as possible. In this case, it is best to consult with a legal professional so that your appeal is properly submitted.
