Now You Won’t Be Able To Travel In Ola, Uber Bikes In Delhi; Here’s Why

Since the time taxi and bike taxi services came out, commuting to one place or the other has become extremely easy for people. However, Delhi’s Transport Department has banned bike taxi services and this has resulted in a major setback for Ola, Uber, and Rapido.

Why Was This Step Taken?

Reasoning that the drivers are using private vehicles for commercial services, the department said that carrying a passenger on a hire or reward basis will be considered a violation of the Motor Vehicle Act, 1988.

This will make the aggregators liable for Rs. 1 lakh fine. The first offence could lead to a fine of Rs. 5000, while a second fine would be Rs. 10,000 and imprisonment for up to a year. Also, the driver is bound to lose his driver’s licence for up to 3 months.

A Similar Case In Supreme Court

Earlier, in a similar case, the Supreme Court denied relief to bike taxi aggregator Rapido against the Maharashtra government’s refusal of returning the driver’s licence.

A bench of CJ DY Chandrachud, and Justices PS Narasimha and JB Pardiwala were hearing the case and said that the amended Motor Vehicles Act makes it clear that aggregators cannot operate without a valid licence.

The Hearing In High Court

The Supreme Court asked Rapido to go to the high court in Maharashtra and also urged the high court to look into the matter independently.

When the matter came to the state government, it said, “There is no regulation on the licensing of bike taxis or the fee structure of bike taxis.”

Then, the high court found evidence that the firm was providing commercial services without obtaining necessary permits from the Maharashtra government, the high court then immediately suspended its services in the state.
